This is a successive application for bail. Record indicates that the charge in the present case has been framed on 1st August, 2018. The list of witnesses annexed to the charge-sheet indicates that, there are 45 witnesses, relied upon by the prosecution in support of its case. Apart from the framing of charge, there is no change in circumstance than what was prevailing on 24th October, 2016 the date on which earlier BA No. 1954 of 2016 was rejected by this Court.

In view thereof, the learned Counsel for the applicant, on instructions, seeks leave to withdraw the application with liberty to file a fresh application for bail before the trial Court, if the trial arising out of CR No.I-218 of 2015 registered with Bhiwandi Taluka

2 /2 27-ba-2164-18.doc Police Station, District Thane, now culminated into Sessions Case No. 24 of 2016 pending on the file of learned Additional Sessions Judge, Thane, does not conclude within a period of six months from today.

Leave and liberty granted.
