The learned Advocate for the Petitioner states that after the copy of the above Writ Petition was served on the Respondent No.1 Bank, the Bank has issued a letter dated 20th October, 2021 to the Petitioner allowing him to participate in the OTS scheme on a condition that the Petitioner will have to deposit an amount of Rs.6,50,000/- i.e. 10% of the claim by the bank. The said letter is taken on record and marked 'X' for identification. The learned Advocate for the Petitioner states that the said amount of Rs.6,50,000/- will be deposited in the course of the day. In view of the above development, the learned Advocate for the Respondent No.1 agrees not to attach the property of the Petitioner and not to take further steps qua the possession notice dated 20th October, 2021 issued to the Petitioner.
