Heard learned APP for the Applicant - State and learned Advocate for Respondent Nos. 1 and 2. They have been acquitted by learned Special Judge for Anti Corruption as per the judgment dated 22nd February, 2019 for the offences punishable under Sections 7, 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988 (49 of 1988). 2.

There is a delay of 44 days in preferring the Appeal. Condonation of delay is opposed on behalf of the Respondents. The same has occurred for completing the procedure for preferring an Appeal. The proposal was routed to Law and Judiciary Department from learned APP and all time was consumed in processing the proposal. This is a satisfactory explanation.

In view of that, delay is condoned. The Application is allowed in terms of prayer clause (a). Application is disposed of. APPLICATION FOR LEAVE TO APPEAL (ALS) (ST) NO. 178 OF 2019 4.

Leave is sought for preferring an Appeal against the judgment of acquittal. Respondents have already appeared in delay condonation application. They waive notice of this Leave Application. 5.
