Shri V.P. Malvankar, AGP "A" Panel for the Respondent No.4. - CORAM :
A.S. OKA & A.K.MENON, JJ DATED : 11TH FEBRUARY 2015 P.C.:
.
Heard learned counsel appearing for the Petitioners and the learned AGP for the Fourth Respondent. There is an affidavit filed by Shri Manu Kumar Srivastava, the Principal Secretary of the Urban Development Department, Mantralaya, Mumbai. The affidavit shows that a Notification contemplated by Sub-section (2) of Section 127 of the Maharashtra Regional and Town Planning Act, 1966 has been published in the Government Gazette of December 12-18, 2013. Though belatedly, compliance has been made by the State Government
ash cp-473.13 with the order of this Court. After having perused the affidavit of Shri Srivastava, we find that this is not a case of willful disobedience of the order of this Court on the part of the State Government. Accordingly, no case is made out for issuing a notice under the Contempt of Courts Act, 1971. The Petition is disposed of.
