The learned counsel appearing for the respondent No.1 submits that in the present case i.e. C.C. No.3529/SS/2015 pending before the Addl. Chief Metropolitan Magistrate, 43rd Court at Borivali, Mumbai. The plea of the accused-petitioner has been recorded in person. The trial has commenced. In view of this, the learned counsel for the petitioner fairly seeks liberty to withdraw the petition. Liberty as prayed for is granted in the interest of justice. The petition stands dismissed as withdrawn.
