P.C. :- 1] Not on board. Upon production, taken on board. 2] The Civil Revision Application instituted by the Applicant was dismissed on 8 September 2015. By this Application, the Applicant seeks a stay on execution of the eviction decree as the Applicant desirous to take recourse against the judgment and order dated 8 September 2015 before the Hon'ble Apex Court. Since the period of four weeks has already expired from the date of pronouncement of the order dated 8 September 2015, there shall be a stay on the execution of eviction decree for a period of eight weeks from today. This shall, however, be subject to the Applicant as well as all adult members of the Applicant's family, who reside in the suit premises, 1/2
DSS p-7-cac-500-15 filing the usual Undertakings in the Registry of this Court within a period of two weeks from today. Copies of such Undertakings to be furnished to the learned counsel for the Respondent-landlord before the same are filed in Registry.
3] Further, subject to any orders that may be made by the Apex Court in the meantime, after the expiry of period of eight weeks from today, the Respondent-landlord shall be entitled to withdraw from the Appeal Court the amounts deposited by the Applicant towards reasonable compensation during pendency of appeal before the Appeal Court.
