The learned counsel for the Applicant on instructions seeks leave to withdraw the application as in the meanwhile a chargesheet is filed and the Applicant is desirous of approaching the learned Sessions Judge. In such circumstances, the Criminal Application is disposed of as withdrawn.

It is made clear that if the Applicant approaches the learned Sessions Judge afresh for bail, the learned Sessions Judge shall decide the application on its own merits and in accordance with law, without being influenced by the withdrawal of the present application.
