The applicant is a juvenile, aged 17 years, who faces accusations in C.R.No.427 of 2022, which invoke Sections 323, 324, 326, 504, 506 read with Section 34 of IPC. The application is fled, since he is apprehending his arrest and the learned counsel would place reliance upon the decision of Division Bench of this Court in the case of Raman & Anr Vs. The State of Maharashtra through police Inspector & Anr. (2022 SCC OnLine Bom 1470), wherein it has been held that anticipatory bail application, by a juvenile can be entertained.

Learned A.P.P., on instructions of the Investigating Offcer, who is present in the Court, makes a categorical statement that considering the role attributed to the applicant in the FIR, he is not desirous of having his custodial interrogation.

In the wake of the above statement, the application is allowed to the following effect.

: ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.427 of 2022 registered with BKC Police Station, applicant-Imran Irfan Shaikh shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or more sureties in the like amount.

(c) The applicant shall report to the concerned police station as and when called for.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Offcer and shall not tamper with evidence.
