The applicant who is accused No. 4 is seeking anticipatory bail in connection with FIR No. 964 of 2021 registered with Kurar Police Station under sections 323, 504, 506(2) r/w. 34 of Indian Penal Code.

Learned Additional Sessions Judge, City Civil Court at Dindoshi, Mumbai by order dated 3rd November, 2021 granted anticipatory bail to accused Nos. 1 and 2 and refused to grant anticipatory bail to the present applicant on the ground that bamboo stick is yet to be seized. The offence is under sections 323, 504, 506(2) r/w. 34 of Indian Penal Code and Mr. Agarkar, learned APP states that subsequently section 354 is added. Sonali

I have perused the FIR and order dated 3rd November, 2021 passed by the learned Additional Sessions Judge, City Civil Court at Dindoshi, Mumbai. The case is made out for granting anticipatory bail on certain conditions. Therefore, following order is passed:-

ORDER

1.

In the event of arrest of the applicant in Crime No. 964 of 2021 registered with Kurar Police Station under sections 323, 354, 504, 506(2) r/w. 34 of Indian Penal Code, he be released on executing P. R. Bond of Rs. 15,000/- with one or two solvent surety in the like amount.

2.

The applicant shall not tamper with the prosecution witnesses and shall attend the Trial Court regularly.

3.

The applicant shall attend the Kurar police station on every Monday between 11.00 a.m. to 12.00 Noon till the filing of the chargesheet and as and when called by the Investigating Officer and shall cooperate in the investigation. 4.

The Anticipatory Bail Application is allowed in above terms and disposed of accordingly.
