This is an application under Section 439 of the Cr.P.C. filed by the Applicant, who is facing trial in Special MCOC Case No.25 of 2019. Learned APP states that the trial has been commenced and five witnesses have been examined and evidence of the sixth witness is being recorded before the Special Court. He states that the entire trial will be concluded within a period of two months. 2.

In view of the said statement, I am not inclined to decide the application on merits at this stage. Application stands disposed of with liberty to file fresh application, if the trial is not concluded within three months.
