Heard Mr. Prashant Patil, learned counsel appearing for the applicant and Mr. Konde-Deshmukh, learned APP appearing for the respondentState. 2.

Mr. Patil invites our attention to the averments made in Interim Application No.2710 of 2021 and submits that there is a delay of more than two years in filing the appeal. He submits that delay in filing the appeal is not intentional.

Learned APP submits that this Court may pass appropriate orders. 4.

In the light of the submissions made by learned counsel appearing for the applicant and the averments in the application, we are satisfied that 1/2

16_IA2710_21.odt the delay has been properly explained. The applicant is in jail since 2015, and therefore by causing delay in filing the appeal, he has not gained any undue advantage. In that view of the matter, delay in filing the appeal deserves to be condoned. Hence, Interim Application No.2710 of 2021 is allowed. Delay in filing the appeal stands condoned. Interim Application No.2710 of 2021 is accordingly disposed of.
