Heard Mr. Satpute, learned counsel for the Applicant. This is a subsequent bail application seeking enlargement on bail under section 439 of Cr.P.C. On 26/9/2016 it was submitted by the learned APP that substantive evidence of 6 witnesses has been recorded and, therefore, this Court was of the opinion that it would not be appropriate to consider the application of bail in the midst of the trial. 2.
As of today, Mr. Yadav, learned APP has received a report which was submitted to him under section 173 of the Cr.P.C. contending therein that 26 witnesses have been examined. 3.
It is under these circumstances that it can be inferred that the trial has reached the stage of conclusion and, therefore this court is not inclined to grant bail. Without going into merits of the matter, the application seeking enlargement on bail is rejected. (SMT. SADHANA S. JADHAV, J.)
