Perused the orders dated 18.04.2022 and 21.11.2022. Submissions of Advocates appearing for both parties are at variance on the issue of valuation of the suit property.

The impugned order dated 16.09.2021 stands quashed and set aside.

Chamber Summons No.742 of 2019 shall be heard afresh by the learned City Civil Court. It is made clear that the objection of Respondents to the issue of valuation of the suit property pleaded by the Petitioner by virtue of the proposed amendment are expressly kept open.

The learned Judge, City Civil Court, Greater Mumbai is directed to hear the parties and dispose the Chamber Summons on merits and pass a reasoned order within a period of four weeks from today. I have not expressed any opinion in the matter. 6.
