Heard learned Counsel for the applicant on the applications for bail and suspension of substantive sentence during pendency of appeal.

The applicant is convicted for the offence punishable under Section 7 and 13(1)(d) read with Section 13(2) of 1 / 3

Prevention of Corruption Act, 1988 and sentenced to suffer imprisonment for three years and to pay fine of Rs.50,000/-. Admittedly the fine amount is already paid on 3.9.2015. During the trial the applicant/appellant was on bail and even after the conviction he has been granted bail by the trial Court. 3.

Considering these circumstances, the applicant be released on same bail as granted by the trial Court with fresh bonds to be executed before the trial Court. The substantive sentence is suspended till the conclusion of the appeal. Both the applications are disposed of accordingly. ( A. R. JOSHI, J.) Deshmane (PS) 2 / 3
