APPP 654 OF 2014.doc P.C. :

1.

By this application, the applicant seeks condonation of delay of 667 days in filing the application for restoration of Criminal Application No.3436 of 2008. We have heard Mr. Moorthy, learned counsel for the applicant, learned counsel representing respondent No.2 and the learned learned APP for the State.

2.

The learned counsel for respondent No.2 has opposed the condonation of delay on the ground that delay has not been satisfactorily explained.

3.

In the companion matter, we have already condoned the delay. In our opinion, the delay has been satisfactorily explained and therefore, we allow this application and condone the delay. [DR. SHALINI PHANSALKAR-JOSHI, J.] [P.V.HARDAS, J.] Page No.2 of 2
