Heard the learned counsel for the parties.

By this application, applicant is seeking to carry out appropriate amendment in cause title of Writ Petition No.7091 of 2012.

The learned Counsel for the applicant submits that by mistake they showed the name of M/s.Unique Castel Co-op.Housing Society Ltd., as respondent no.2 instead of Deputy Registrar, Cooperative Societies. To that effect, he has made averments in paragraph 8 of the Civil Application. Considering the submissions made by the Mohite 1/2

33 caw1025-17 learned counsel for the applicant, the averments made in Civil Application in paragraph 8 and 9, I am satisfied that the applicant has made out a case for allowing Civil Application. Hence, following order is passed:

a) Applicant is permitted to delete the name of respondent no.2 as stated in cause title and substitute Deputy Registrar, Co-operative Societies with his full address.

b) Amendment be carried out during the course of the day.

c) If amendment is carried out during the course of the day, advocate for the applicant is directed to provide amended copy of Petition in the office of Government Pleader, Appellate Side, Bombay within one week from today.
