DATE : 26 OCTOBER 2023 P.C.:
The Petitioner had filed Original Application No. 319 of 2015 in the Maharashtra Administrative Tribunal (the Tribunal), Mumbai seeking condonation of breaks in service during the period from 13 November 1997 to 27 September 2000 and regularization of service with effect from 15 October 1997. The Tribunal rejected the Original Application by order dated 2 May 2016. 2.
The Petition filed in the year 2016 is not being diligently prosecuted. When the Petition came up on board on 20 July 2017, none had appeared for the Petitioner. Again none had appeared for the Petitioner on 31 July 2017. Thereafter, on 29 August 2019, none had appeared for the Petitioner. Even today, none appears for the Petitioner.

It is clear that the Petitioner is not interested in prosecuting this Petition. The Tribunal has taken a view that the Petitioner is not entitled for regularization, however, the Petitioner is entitled to condonation of technical breaks in her ad-hoc service and also increments for ad-hoc service and that part is not challenged by the State.

In these circumstances, we dismiss the Writ Petition for nonprosecution. (MANJUSHA DESHPANDE, J.) (NITIN JAMDAR, J.)
