Versus
State of Maharashtra and another ..Respondents Ms. Pooja V. Thorat I/by S. R. Karpe a/w V. V. Mohite, Advocate for the Petitioner.
Mr. S. B. Kalel, AGP for the Respondent No.1 - State. Mr. S. S. Patwardhan, Advocate for the Respondent No.2. CORAM : B. R. GAVAI & M. S. KARNIK, JJ.
DATE : 30th AUGUST, 2018 P.C.
1] The limited grievance of the Petitioner is that in view of clause (o) of the notice dated 18th August 2018 issued by the Respondent No.1, the case of the Petitioner would be considered at the bottom of the merit list of the third round and as such, the Petitioner may not get college of his choice. 2] However, Mr. S. S. Patwardhan learned counsel appearing on behalf of the Respondent No.2 makes a categorical statement that contention of the Petitioner is incorrect regarding the meaning of the said clause. It is stated that the final list referred to BGP. 1 of 2

in the said clause is the final merit list after first and second rounds. It is submitted that the Petitioner's claim would be considered in the third round and not after the admissions in the third round are completed.
3] In that view of the matter, we do not find that there is any need to interfere. The Petition is disposed of by accepting the statement made on behalf of the Respondent No.1.
