Heard Mr. Avinash Fatangare, learned counsel appearing for the Petitioners and Mr. Sawant, learned AGP appearing for Respondent Nos.6 to 9.

Mr. Fatangare, learned counsel appearing for the Petitioners states that very limited prayer is sought by the Petitioners. He states that the Petitioners have filed the Revision Application before the Hon'ble Revenue Minister on 7th February 2023. He states that despite repeated requests, the said Revision Application is not taken for admission and also for interim relief.

Mr. Sawant, learned AGP appearing for Respondent Nos.6 1/2

908-wp-10790-2023.doc Sonali to 9 states that he has taken instructions and the said Revision Application will be decided within a period of four months from today.

The impugned order before the Respondent No.6 is passed by the learned Additional Commissioner, Kokan Division, Mumbai by which the matter was remanded back to the Respondent No.9 i.e. learned Sub Divisional Officer, Ulhasnagar, Dist. Thane. The Respondent No.9 is directed not to proceed with the proceedings bearing RTS Appeal No.41 of 2023, till the Hon'ble Revenue Minister decides the Revision Application filed by the Petitioners before him.

The Writ Petition is disposed of in above terms with no order as to costs. It is clarified that all the contentions on merits are expressly kept open.

In view of the nature of this order, no notice is issued to the Respondent Nos.1 to 5. However, it is clarified that the said Respondents are at liberty to approach this Court, if necessary. [MADHAV J. JAMDAR, J.] 2/2
