On second call, none appeared for the petitioner. This petition is by the victim of a crime punishable under the provisions of POCSO Act. The accused is already charge-sheeted and the charge in the matter is framed.

In the aforesaid background, the claim put forth by the victim girl along with the complainant for quashing, cannot be entertained particularly having regard to the presumption under Section 23 of the POCSO Act.

As such, the petition stands dismissed.
