This is an Application for cancellation of pre arrest bail granted to Respondent No.2 vide order dated 08/06/2017 passed by the learned Additional Sessions Judge-3, Thane in Anticipatory Bail Application No.1192/2017.

Heard Mr. Sachin Kanse, learned counsel for the Applicant and Mr. S.V. Gavand, learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsels for the respective parties.

The only ground for cancellation of bail, as canvassed by the 1/2

P.H. Jayani 19 APPLN499.2017.doc learned counsel for the Applicant, is that the Respondent No.2 may tamper with the evidence. Suffice it to say that the bail which was granted to the Respondent No.2 cannot be cancelled on such vague apprehension. It is also on record that this Court had granted pre arrest bail to the co-accused vide order dated 13/07/2018 in Anticipatory Bail Application No.1135 of 2017.
