Heard Mr.Waskar, learned counsel for the appellant. 2.

Mr. Waskar, learned counsel for the appellant submitted that delay of 64 days caused in filing the appeal is due to bona fide and unintentional reasons. Mr. Waskar submitted that the family of the appellant was supported by his brother - Rajesh. Unfortunately, brother - Rajesh suffered illness and eventually he passed away. As there was no other alternate member in the family, the family of the appellant was unable to make arrangement of funds or seek legal assistance. After making necessary arrangements and after taking appropriate steps, the appeal is filed in this Court. In view of the submissions of learned counsel for the appellant and for the reasons stated in the application, particularly, under caption "GROUNDS", the criminal application is allowed.
