This Petition takes exception to the order dated 7th August, 2018 passed below Exhibit 24 and order dated 8th August, 2018 passed below Exhibit 25 in Execution Application No.78 of 2017 passed by the learned Judge, Court Room No.14 of the Court of Small Causes at Mumbai. By order dated 7th August, 2018 below Exhibit 24, the learned trial Judge rejected the application taken out by the petitioner for deciding MARJI Application first before proceeding with Execution Application No.78 of 2017. By order dated 8th August, 2018 passed below Exhibit 25, the learned trial Judge rejected the application made by the petitioner to keep in abeyance execution proceedings as the petitioner intends to file application to transfer the matter to other Court.

After arguing the Petition for quite some time, Mr. Pandey seeks permission to withdraw the Petition. The Petition is allowed to be withdrawn and is dismissed as such. Order accordingly.
