By the present application, the applicant prays for quashing and setting aside the order dated 18.12.2004 passed by the Metropolitan Magistrate, 18th Court, Girgaon, Mumbai and also the order passed in appeal by Adhoc Sessions Judge, Mumbai. The learned counsel for the applicant tenders before the Court an order passed on an Application No.95/SW/09 filed the respondent Smt.Najma Rafiq Ahmed Shaikh, the respondent in the present matter. In the said proceedings the present petitioner Rafiq Ahmed Nisar Ahmed Shaikh is impleaded as respondent No.1 along with other three respondents. This is an application under Section 12 read with Section 18, 19, 20, 21, 22 and 23 of the Domestic N.S. Kamble page 1 of 2

51-apl-928-2013.doc Violence Act, 2005. An order is passed on the said application on 22.04.2018 which reads thus :- "In view of report of Judge Mediator dt. 28/9/17 Ex. 63 & settlement forms at Ex.64. This D.V. case disposed off for want of prosecution."

The said order passed on the application is taken on record. In view of the settlement terms exhibited at 64 before the Magistrate Court and in view of the disposal of the D.V. case nothing survives in the present criminal application and it is disposed of.
