Heard learned Counsel for the applicant and learned APP. 2.
According to learned Counsel, the learned trial Court rejected applicant's anticipatory bail application as no FIR was forthcoming, and was of the opinion that the applicant is suppressing true facts from the Court. According to learned Counsel, even if it is that the FIR has not been registered but there is every apprehension of his being arrested inasmuch as the applicant is repeatedly receiving phone calls from API of Vishrambag Police Station, Pune in connection with the complaint lodged by complainant. Learned Counsel therefore requested that Trupti 1/2
10-ABA-2730-2021.DOC at least he be given certain time to approach the competent court in the event of any FIR being registered against him. 3.
In view of above, considering the facts and circumstances of the case, in my considered opinion, the respondent can be asked to give 72 hours notice to the applicant in the event the respondent desires to arrest the applicant. Hence, the following order :
ORDER
(i) In the event the respondent finds it necessary to arrest the applicant in connection with the complaint lodged by and on behalf of M/s. Manthak Business Solutions Pvt. Ltd. with Vishrambag Police Station, Pune, the applicant be given 72 hours advance notice. (ii) Application is disposed of in above terms. (V.G.BISHT, J. ) Trupti 2/2
