The petitioner was granted bail by the Court of learned Additional Sessions Judge, Borivali, Division Dindoshi, Mumbai vide order dated 19th December, 2020 in connection with C.R. No. 1560 of 2020 registered with Malvani Police Station for the offence under Sections 376, 323, 504 and 506 of Indian Penal Code and on executing P.R. Bond in the sum of Rs.25,000/- with one or more surety/sureties in the like amount.

The petitioner was also permitted to furnish cash bail to the tune of Rs.25,000/- for a period of two months. The petitioner did not seek extension of time to furnish surety. Recently the petitioner moved an application before the Sessions Court seeking extension of time to furnish surety, which has been rejected vide order dated 7th September, 2022.

Learned Advocate for petitioner submitted that the petitioner has co-operated with the investigation. The Investigation is completed. The petitioner may be granted four weeks time to furnish surety in accordance with order dated 19th September, 2020 and the facility of cash bail may be extended by four weeks. 4.
Learned APP submit that on account of the lapses on the part of the petitioner the Investigating Officer could not file chargesheet. Ultimately the charge-sheet has been filed and submitted before the concerned Court. The petitioner had appeared before the trial Court and has undertaken to furnish surety as per the order dated 19th December, 2020.

Though there are lapses on the part of the petitioner, in the interest of justice time to furnish surety in accordance with order dated 19th December, 2020 passed by the Additional Sessions Judge, Borivali, Division Dindoshi, Mumbai in Bail Application No. 1292 of 2020 is extended by four weeks from today. The facility of cash bail is also extended by four weeks from today. 6.
Petition stands disposed off.
