This is an application for regular bail in CR No.85/2015 registered with Shivaji Park Police Station, Mumbai under Section 370(3) read with 34 of the I.P.C. and under Section 3,4,5,7(1) of the Prevention of Immoral Trafficking Act,1956.

2) It is the case of the prosecution that the complainant a police constable lodged FIR on 10.4.2015 stating that on receipt of particular information they raided the premises situated at B705 New Samadhan Apartment, Senapati Bapat Marg, Dadar (West) Mumbai wherein the applicant and other accused persons under the garb of

2 /3 massage center used to run a brothel. After lodging of the FIR, the investigation was carried out and after completion of the investigation charge sheet has now been filed. The role attributed to the applicant is that he is the agent and used to provide customers to the victims. The applicant used to do the said act under the guise of, he being the Manager of the said Massage Center. The applicant is arrested on 10.4.2015 and since then he is in Jail. I have perused the charge sheet. It appears form the charge sheet that on the date of raid at the said premises two victims ladies who were found at the said place where 27 and 30 years approximately. It appears prima facie that the said ladies were indulging in the vocation in the prosecution at their own will. Taking into consideration the said aspect, I am inclined to grant bail to the applicant. Hence, I the following order.

ORDER

a) The applicant shall be released on bail in CR No.85/2015 registered with Shivaji Park Police Station, Mumbai on his furnishing PR bond in the sum of Rs.1.00 lac with one or two solvent sureties in the like amount.

b) The applicant shall report to the Investigating Officer on the first Monday of every

3 /3 month between 10.00 a.m. 12.00 noon till the pendency of the trial.

c) The applicant shall not tamper the prosecution evidence or influence the prosecution witnesses.

d) Application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
