Today When the matter came up for hearing, learned counsel for the parties submit that the question involved in this petition has already been considered and decided by this court on 25.09.2017 in the case of Shaikh Saniya Anam Waheed Tadvi Vs. The State of Maharashtra and Ors in Writ Petition (St) No. 25740 of 2017. Learned counsel for the parties submit that the order impugned in this petition is also the same order which has been impugned in Writ Petition (St) No. 25740 of 2017. In the circumstances, as agreed by the learned counsel for the parties, this petition is also disposed of in terms of the said order which reads as under :

hvn WP-10294.2017 (a) The impugned order dated 31/08/2017 passed by the Caste Scrutiny Committee is quashed and set aside.

(b) Respondent No.2 Caste Scrutiny Committee is directed to forthwith issue the caste validity certificate in favour of the petitioner as belonging to Tadvi, Scheduled Tribe, on receipt of the authenticated copy of this order.

(c ) Rule is made absolute in the above terms. No costs.
