The applicant face accusations for the offences punishable under sections 363, 364-A, 342 r/w 34 of IPC in connection with C.R. No. I- 315 of 2021 registered with the Wada Police Station. 2.

The case of the prosecution as could be discerned from the material, which has surfaced through the FIR, and the statement of the victim girl reveal, that the victim girl was kidnapped by one person while she returned from her school and reached her building. The girl aged 12 years old was forcibly made to sit in a car, where two persons were already seated. She was made to sit in the rear seat of the car and her face was covered by a plastic sack and her hands and legs were also tied. After that, she was blind folded, but when it Ashish Mhaske

2/2 909 ABA 2598.22.doc was removed she could identify the person who was driving the car as Sameer Thakare, and described her association with him, by stating that he is the teacher in Chanakya academy, where she was attending the classes.

The victim girl has specifically given the further narration in her statement, when she was confined in a room, which was located in a Jungle and she was threatened, that harm would be caused to her if her father do not pay the money, as he was a rich man. On the next day since the police reached the spot the accused persons ran away and she was rescued.

The one person, who has been identified by the victim girl i.e. the co-accused, in remand, has named the present applicant. There is no reason why it is only he, has been particularly named by the co-accused, and therefore it has become necessary to ascertain the veracity of the said statement. His custodial interrogation is very necessary.

Hence the application is rejected.
