This is an application filed by the Applicant under the provisions of Section 438 of the Code of Criminal Procedure seeking prearrest bail in connection with C.R. No.219 of 2021 registered with Karjat Police Station, District-Raigad, for the offences punishable under Sections 420, 406, 409, 465, 467, 468, 471 and 120B of the IPC and Sections 3, 8, 11 and 13 of the Maharashtra Ownership Flats (Regulation of the promotion of construction, sale, management and transfer) Act, 1963.

I have heard Mr. Parkar, learned counsel appearing for the Applicant and Mr. Gavai, learned APP for the Respondent-State 1/3

I have already allowed Anticipatory Bail Application No.2378 of 2021 filed by co-accused, Rajesh Krishnan by a separate order. The role of the Applicant herein appears to be that of a nominal contractor, who has signed some of the documents at the instance of the Managing Directors. The Applicant is already on interim protection granted by this Court on 18 November 2021. Considering the role ascribed to the Applicant, in my view, the interim protection granted in favour of the Applicant needs to be made absolute. Accordingly, I proceed to pass the following order:- (i) The interim protection granted in favour of the Applicant by order dated 18 November 2021 is made absolute.

(ii)In the event of arrest of the Applicant in C.R. No.219 of 2021 registered with Karjat Police Station, DistrictRaigad, the Applicant is ordered to be released on bail on furnishing PR bonds in the sum of Rs.25,000/- with one or two sureties in the like amount.

(iii)The Applicant shall remain present before the Investigating Officer as and when summons to that effect is received and shall co-operate with the Investigating Officer for expeditious completion of the investigation.

(iv) The Applicant shall not tamper with the prosecution evidence and/or influence the witnesses in any manner.

(v) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, and /or change of residence or mobile details, if any, from time to time.

(vi) The Applicant shall not leave India till the investigations are completed and charge-sheet is filed.

With the above directions, the Anticipatory Bail Application is allowed and disposed of.
