The impugned order is passed at the ad-interim stage. Learned Counsel for the parties are agreed that this Appeal from Order be disposed of in the following terms:

(1) The Exhibit 5 Application shall be disposed of as expeditiously as possible and in any event within a period of eight weeks from today.

(2) The statement of learned Senior Counsel for the Appellant, on instructions, is recorded that the Appellant shall not create third party interest in the suit property until the disposal of the Exhibit 5 Application. The impugned order would stand substituted by the Statement of the learned Senior Counsel for the Appellant. .
