By this Civil Application, Applicant is seeking stay of the operation and implementation of the impugned judgment and award dated 21.10.2011 passed by MACT, Nashik in MACP No.570 of 2006 holding that the Respondent original Claimants are entitled Mohite 1/2

5 caf3844-18.doc sum of Rs.76,000/- by way of compensation inclusive of no fault liability along with interest @ 7.5% p.a. from 1.1.2010 till realisation of the amount.

The learned counsel for the Applicant submits that it is not possible for Applicant to deposit said decreetal amount in the Trial Court. Hence, he received instruction to withdraw the present Civil Application. To that effect, he has given in writing. Same is taken on record and marked "X" for its identification. Same is accepted.

Civil Application stands dismissed as withdrawn. No order as to costs.
