Heard both sides. While releasing the applicant / accused on bail on 5th May, 2014 this Court directed the applicant to attend the police station on every first Monday of the month till the conclusion of trial.

The learned counsel appearing for the applicant states that on the day on which order releasing the applicant / accused was passed, the charge-sheet was already filed. 1/2

Be that as it may, the crime in question was registered in the year 2014. The learned APP submits that Regular Criminal Case is now pending in the Court of the learned J.M.F.C., Kolhapur. After filing of the charge-sheet and registration of the criminal case, there is no propriety in continuing the condition of the order directing the applicant to attend the police station on every Monday. Even otherwise, the applicant is required to attend each and every date of hearing before the learned J.M.F.C., Kolhapur. Hence the order :- (i) The application is allowed;

(ii) Condition 7 (iii) directing the applicant / accused to attend the police station is relaxed;

(iii) The applicant / accused may not attend the police station in this offence / crime;

(iv) Needless to mention that applicant / accused shall attend the trial Court on each and every date of hearing; (v) The application is disposed of accordingly.
