This application is under Section 24 of the Code of Civil Procedure filed for transfer of Hindu Marriage Petition No.50 of 2014, pending in the Court of Civil Judge, Senior Division, Satara to the Court of Civil Judge, Senior Division, Barshi. The transfer is sought on the ground that is is extremely difficult for the applicant to travel to the court at Satara from Barshi for attending to the every date of the matter and there is also a small child to be looked after. Mr. Zade, the learned advocate for the respondent opposes the application. However, perusal of the petition filed by the respondent shows that it is his allegation that the respondent is not mentally sound and that her

If that is the condition of mental health of the applicant, it would not just be convenient but also in the interest of justice that the applicant is not subjected to the travel to Solapur for attending to the matrimonial proceedings. Hence, Miscellaneous Civil Application is allowed in terms of prayer clause (a). (Smt. R.P. SondurBaldota, J.)
