Heard the learned A.G.P. for the applicant.
This application is preferred by State of Maharashtra for condonation of 7 years 7 months delay to comply the order dated 5.2.2007 passed by this court for filing of private paper book.
The learned A.G.P. for the applicant submits that paper book is ready. He undertakes to file the same within four weeks from today. Considering the submissions made by the learned counsel for the applicant, the averments made in Civil Application and as the statement made by the learned A.G.P., paper Mohite 1/2
23 caf199-15.doc book is ready and he undertakes to file the same within four weeks from today, I am satisfied that the applicant has made out a case for allowing Civil Application. Hence, following order:
a Delay in preferring Civil Application is condoned.
b Time is extended by four weeks from today to comply the order dated 5.2.2007 i.e. filing of private paper book within four weeks from today, failing which Civil Application shall stand dismissed without referring back to the court. c Applicant is directed to communicate this order to the respondent either by registered post A.D. and/or by hand delivery and file Affidavit of Service to that effect.
