Heard. This is an application under Sectiion 438 of Cr.P.C. The applicant herein is apprehending his arrest in Crime No.390 of 2016 registered at Tembhurni Police Station, Dist. Solapur for ofences punishable under Sections 306, 201 read with Section 34 of the Indian Penal Code. 2.

By an order dated 22.9.2016, after perusing the papers of investigation, this Court had granted ad-interim relief in favour of the applicant. It is not the case of the prosecution that the applicant has not abided the conditions imposed upon him. Hence, the order dated 22.9.2016 deserves to be confirmed. The papers of investigation would also reveal that it cannot be said that the applicant had abetted, instigated or facilitated

The above observations are restricted to an application under Section 438 of Cr.P.C and shall not be considered for the purpose of quashing of FIR, discharge application or at the time of trial.

O R D E R

(i) In the event of his arrest, the applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount.

(ii) The applicant shall report to the concerned police station on first Sunday of each month till the filing of the charge sheet. The application stands disposed of.
