Heard learned counsel for the Applicant and learned APP.

The learned counsel for the Applicant submitted that, this Court (Coram : M.S. Karnik, J.) has granted bail to the Applicant, while imposing condition this Court has imposed condition that, till the time the evidence of child witness is N.S. Kamble page 1 of 3

recorded, the Applicant shall not stay in Mumbai/Mumbai suburban district. The Applicant may re-enter after the evidence is recorded. The learned counsel further submitted that, charge has not been framed. The Applicant work's in entertainment industry, she has got assignment from Mumbai, she requires to enter the Mumbai. Hence, requested to modify the bail condition imposed by this Court.

The learned APP, on instructions, submitted that, at present victim is staying in Assam. Hence,appropriate order be passed.

I have heard both learned counsel.

As the victim is staying in Assam and Applicant has received assignment for work in Mumbai.

In view of above, I pass following order.

ORDER

(i) Application is partly allowed.

(ii) The Condition No.(d) of order dated 22nd February 2023 is modified as under :- N.S. Kamble page 2 of 3

"The Applicant can enter in Mumbai and Mumbai suburban district, if victim comes in Mumbai Applicant shall not contact her and shall not enter the area where victim stays or witnesses stays".
