This is an application for suspension of sentence passed by the learned Additional Sessions Judge, Thane under section 135 of the Electricity Act wherein the applicant has been convicted and sentenced to undergo Rigorous Imprisonment for two years and fine amount of Rs.6,06,070/- (Rs. Six Lakh, Six Thousand Seventy only) and in default, to undergo Simple Imprisonment for one year.

Heard the learned Counsel for the applicant. He submits that the applicant is ready to deposit entire fine amount within four weeks. The 1/2

6-appa-1385-2019.doc statement is accepted. The learned Additional Public Prosecutor has no objection for releasing the applicant on bail, pending the appeal, if he deposits the fine amount within four weeks as undertaken. 3.

As such, the applicant be enlarged on bail by executing a P.R. bond in the sum of Rs.25,000/- with one or two sureties to the satisfaction of the learned Additional Sessions Judge, Thane subject to the applicant depositing a fine amount as stated hereinabove within four weeks which is a condition precedent.

The applicant shall attend this Court as and when directed. 5.

The application stands disposed of in the aforesaid terms. 6.

In view of disposal of Criminal Application No.1385 of 2019, Criminal Application No.1386 of 2019 stands disposed of. 7.

S.O to 10th February, 2020 for compliance.
