By this Writ Petition, the Petitioners seek directions to select them for transfer to open prison from the prison wherein they are undergoing sentences.

The learned APP submits that the Petitioners, being convicted for the offences punishable under Sections 395 and 396 of the Indian Penal Court, are not entitled to be selected for open prison. It appears that the request of the Petitioners was considered by the Superintendent of Kolhapur Central Prision, Kalmba, and the same was rejected. The said fact was communicated by the jail authority to the Registrar of this Court by letter dated 09/09/2013, which letter is part of the record of this Writ Petition.
