At the request of the learned counsel for the appellant, matter is taken on production board.

The learned counsel for the appellant submits that she received instructions from her client to withdraw the present First Appeal. To that effect, she has given in writing. Same is taken on record and marked as 'X' for identification. Same is accepted.

2 508.190.19 fa.doc The learned counsel for the appellant submits that at the time of First Appeal, they deposited sum of Rs. 25,000/- in the Registry. She submits that Registry be directed to refund the said amount alongwith accrued interest, if any, to the appellant without furnishing any security. The learned counsel for the appellant further submits that refund of Court fees may be directed according to law. Hence, following order:

(I) First Appeal as well as Civil Application stand disposed of as withdrawn.

(II) Appellant is entitled to amount of Rs. 25,000/- deposited by them at the time of filing the First Appeal in the Registry of this Court alongwith accrued interest, if any, without furnishing any security.

(III) Refund of Court fees as per law.
