1] The Applicant is apprehending arrest in CR No.391/2021, which came to be registered on 11.10.2021 with Padgha Police Station. On completion of investigation charge-sheet has been filed against three accused persons. The present Applicant is shown to be absconding and when the charge-sheet placed on record is perused, it is seen that the Applicant is attributed role of receiver of the stolen property. Unfortunately, Section 411 of the Indian Penal Code has not been invoked.
2] In any case, the learned APP makes a categorical statement that the Applicant is not accused of theft on the basis of material compiled in the charge-sheet filed against other accused persons. 1/2
(907)ABA-2605-2022.doc 3] In the wake of aforesaid statement, the Applicant needs to be protected.
Hence, the following order :
O R D E R
(a) Application is allowed.
(b) In the event of arrest in connection with C.R.No.391/2021 registered with Padgha Police Station, the applicant Paresh Dattatray Kasar shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.
(c) The applicant shall report to the concerned police station on 28.09.2022 to 30.09.2022 at 3.00 p.m. and thereafter as and when called for.
(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
