Learned A.P.P., on instructions, submitted that, the investigation of the present crime has already been completed and the chargesheet is ready to be submitted before the Court of competent jurisdiction. However, in view of Order dated 27th September 2022, the same could not be filed till today. He submitted that, if Court permits, the said chargesheet will be filed before the Court of competent jurisdiction within a period of two weeks from today.

In view thereof, we grant permission to the concerned Investigating Officer to submit chargesheet against the Petitioners. Order dated 27th September 2022 is accordingly modified. 1/2

As the Police are submitting chargesheet in the present crime, Mr.Shah, learned counsel for the Petitioners, on instructions, seeks leave to withdraw present Petition with liberty to file either an application for discharge or to contest the case, as may be permissible under the provisions of Cr.P.C. before the trial Court.

Leave and liberty granted.
