Heard Mr. Surel Shah, learned advocate for the Applicant and Mr.Vaibhav Ugle, learned advocate for Respondent No.1. 2.

Bare perusal of Exh. 60 i.e. statement of Respondent No.1 recorded by Tahshildar, a quasi-judicial Authority constituted under the Maharashtra Rent Land Revenue Code, 1996 clearly indicates that, he has given an unambiguous admission that the Appellant who is a successor in tile of the suit well is having one and half share in it. The said Exh.60 assumes its own evidential value in the eye of law.

In view thereof, the interim relief in terms of prayer clauses [A], [B] and [C].
