Heard finally, by consent of the parties.
We are inclined to dispose of the present Writ Petition as it is settled that the "order of reference is only an administrative order, which does not decide the rights of the parties". Therefore, by keeping all points open, the observations even if any, in the order of reference 1/2
ssm 2 924-wp10026.15.sxw dated 23 July 2015, the learned Authority to decide the reference, uninfluenced by the said observations, as early as possible. All contentions are kept open.
Both the learned counsel appearing for the respective parties, submitted that as the pleadings are ready and the matter pertains to the closure issue, the matter be expedited. Order accordingly.
In view of above, prayer clause (a) is not pressed. Writ Petition is accordingly disposed of in the above terms. There shall be no order as to costs.
Rule disposed of accordingly.
