This is an application for permitting the applicant to furnish cash bail for a period of four weeks in CR No.390 of 2013 registered with Powai Police Station, Mumbai.

By an order dated 28.4.2015 the applicant was directed to be enlarged on bail on his furnishing PR bond in the sum of Rs.15,000/- with one or two solvent sureties in the like amount. The learned Counsel for the applicant submited that though the order was passed on 28.4.2015, since then the applicant is languishing

in jail as his relatives could not get one or two solvent sureties in the like amount. She therefore submitted that the applicant may be permitted to furnish cash bail for the period of four weeks. She submitted that after his release from jail, within four weeks the applicant will furnish one or two solvent sureties as was directed by the order dated 28.4.2015. It is the fact that though the order releasing applicant on bail was passed on 28.4.2015, till date the applicant could not comply with the condition no.1 of the said order and is inside the jail . For the reasons stated in the present application and in the interest of justice, I am inclined to allow the present application.

Hence, the following order:

The applicant is permitted to furnish cash bail of Rs.15,000/- for a period of four weeks from 11.1.2016. After his release from jail, the applicant shall comply with conditions imposed upon him in the order dated 28..4.2015.

The application is allowed in the aforesaid terms. (A.S. GADKARI,J.)
