On 8 July 2015 this Court has passed following order: "

This Petition is filed under section 11 of the Arbitration & Conciliation Act, 1996 for appointment of an Arbitrator.

Learned Counsel for the parties state that they are agreeable to the appointment of an Arbitrator being a Fellow of the Indian Institute of Architect to adjudicate the disputes and differences between the parties. However, since they have not been able to arrive at the consensus as to choice of the Arbitrator, both the Counsel have left it to the Court to appoint an Arbitrator.

Stand over to 15 July 2015 (H.O.B.)."

Learned Counsel for the parties are agreed to the appointment of Mr. Avinash V. Pendse, B.Architecture, PGDIIT, having his address at 7, Tukaram Niketan, Bhagat Lane, Mahim, Mumbai - 16, to be the sole Arbitrator to adjudicate the disputes and differences between the parties. 1/2

k 2/2 16 arp 80.14 as .doc Learned Counsel for the parties are also agreed that the venue of the Arbitration will be in Mumbai. In the circumstance, the following order is passed:

ORDER

i) Mr. Avinash V. Pendse, B.Architecture, PGDIIT, is appointed as sole Arbitrator under the Arbitration & Conciliation Act, 1996 to adjudicate the disputes and differences between the parties. ii) Registry shall communicate a copy of this order to the sole Arbitrator together with a memorandum of address of parties. The Petition is disposed of in aforesaid terms. No order as to costs.
