IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 3325 OF 2016 Vrinda Keshav Bele and Others.

..Petitioners.

Versus

Rajesh Nagarmal Bansal & Others.

..Respondents.

Mr. S. A. Tarale for the Petitioners.

Mrs. G. P. Mulekar, APP for the State.

Coram : Ranjit More & Dr. Shalini Phansalkar-Joshi, JJ.

Date : December 1, 2016.

P. C. :

1.

Heard. Petition is filed seeking direction to the Respondent Nos.3 to 5 to register an FIR against Respondent Nos. 1 and 2 on the basis of Petitioner's complaint. 2.

It is not disputed that on the basis of said complaint of the Petitioner, Khandeshwar Police Station has registered NC case for the offence punishable under sections 427 and 506 read with 34 of the Indian Penal Code, 1860. We are of the opinion that the Petitioner has an alternate remedy to approach the magistrate if he is not satisfied with the registration of NC case. We are, therefore, not inclined to entertain this writ petition in exercise of writ jurisdiction of this Court under Article 226 of the Constitution of India and the same is accordingly dismissed.
