By the present Application, the Applicant-wife is seeking transfer of Marriage Petition No. 1128 of 2021 filed by the husband in the Court of Civil Judge Senior Division, Kalyan to the Family Court at Bandra, Mumbai.

Heard the learned Counsel Ms. Kode for the Applicant and perused the application.

Considering the principle that the parties are governed by the dominus litis and since it is a choice of the husband to file the proceedings, if it is permissible to bring the same within the jurisdiction of the said Court, mere convenience of the wife cannot be a ground to transfer the proceedings.
