The learned counsel for the parties submit that earlier Arbitrators, whose names were suggested as per the judgment dated 8th September, 2009 in First Appeal No. 820 of 2005 with Civil Application No. 1706 of 2008, are not in a position to do the work, hence the parties want to engage another Arbitrator.
