According to the prosecution case, there was an attempt to commit dacoity in Porbunder-Secunderabad Express at Kurduwadi. Witnesses for prosecution and particularly, the first informant had come across dacoits and he had identified them. In this view of the matter, the following order: (1) Leave as prayed is granted.

(2) Application for grant of leave to be treated as memo of appeal.

(3) Admit.
